Investigation Underway: Carbon Monoxide Leak at Nashville Daycare Center Elm Hill Academy

Sanford Heisler Sharp McKnight would like to speak to parents whose children attend the Elm Hill Academy daycare center in Nashville, Tennessee. Our firm is investigating a January 5, 2024 incident at the school in which a carbon monoxide leak led to the evacuation of the school, and whether Elm Hill Academy was negligent in exposing children to harm.

Children at Elm Hill Academy Required Medical Care

As a result of the carbon monoxide leak, a number of students required medical care and will continue to need monitoring. We are representing the parents of an eight-month-old girl who was placed on over six hours of oxygen treatments after tests showed double the safe amount of carbon monoxide in her bloodwork. Doctors have since instructed our clients to monitor their daughter both for lung damage (dry coughing) and missed developmental milestones that could be early signs of brain damage. More than 100 children, from infants to pre-kindergarten, attend Elm Hill Academy, and many of them may experience health issues as a result of the carbon monoxide leak.

Schools Have a Duty to Protect a Child’s Well-being

Elm Hill Academy is owned by Otter Learning, a for-profit company operating early childhood education facilities in the Southeast, including Nashville. When parents drop their kids at school, the school must take reasonable measures to ensure the children’s well-being. Our firm is interested in speaking to parents of children who attended Elm Hill Academy between November 2023 and January 2024 to explore whether Elm Hill Academy breached its duty of care to the students and their parents.
