Lawsuit Seeking $100 Million Claims UPS Denies Account Managers Overtime Pay Aproposed collective and class action lawsuit filed Aug. 19 seeks $100 million in unpaid compensation and damages on claims that United Parcel Service Inc. has failed to pay overtime compensation to at least 100 account managers in violation of the Fair Labor Standards Act and California state laws (Meza v. United Parcel Svc. Inc., S.D. Cal., No. 09-1798, complaint filed 8/19/09).

The lawsuit filed in the U.S. District Court for the Southern District of California claims the company ‘‘trample[s]’’ on state and federal wage laws and hurts the economy by wrongfully classifying account managers such as lead plaintiff Laura Meza as overtimeexempt outside sales or administrative employees. ‘‘Because overtime laws help motivate companies to hire more workers to get the job done, they’re the kind of economic stimulus that we can’t overestimate in today’s dire economic climate,’’ plaintiffs’ attorney Jeremy Heisler said in an Aug. 19 statement.
