Sanford Heisler Sharp has brought a class action for unpaid wages on behalf of Plaintiff Paul Love and similarly-situated dump truck drivers who worked in Virginia. Plaintiff alleges that Defendants Virginia Land Improvement Corp. and Crossing Place Transport Inc. engaged in unlawful pay practices and violated the federal Fair Labor Standards Act (“FLSA”) and Virginia state common law.
According to the complaint, Defendants regularly failed to compensate the Virginia truck drivers for both straight time and overtime during weeks in which they worked over 40 hours. The complaint alleges the unpaid hours included time spent work at the Defendants’ base and driving company-owned trucks to, from, and between construction sites and the base.
Following a lengthy investigation and extensive negotiations, the parties reached an agreement to settle the claims on behalf of the 60-person class for $125,000. On September 11, 2019, U.S. Magistrate Judge Theresa Buchanan granted Plaintiff’s motion for final approval of the settlement class.
