Case Summary

In March 2019, Sanford Heisler Sharp McKnight brought a class action lawsuit against Virginia Land Improvement Corp. and Crossing Place Transport Inc. on behalf of Plaintiff Paul Love and a class of dump truck drivers, alleging violations of both the federal Fair Labor Standards Act (“FLSA”) and Virginia state common law.

The Complaint alleged that VLIC and Crossing Place regularly failed to compensate the Virginia truck drivers for both straight time and overtime during weeks in which they worked over 40 hours. According to the Complaint, the unpaid hours included time spent working at the Defendants’ base and driving company-owned trucks to, from, and between construction sites and the base.

In September 2019, the Court granted final approval of a $125,000 settlement reached on behalf of the 60-person class.
