Case Summary
The nationwide class action, which was initially filed in October 2012, was brought on behalf of more than 3,000 delivery drivers who were allegedly misclassified as independent contractors by Fleetgistics. The Plaintiffs alleged Fleetgistics denied them overtime pay and forced them to pay for business expenses, in violation of the Fair Labor Standards Act (“FLSA”) and state laws.
According to the Complaint, Fleetgistics, which operated a national delivery service, mislabeled delivery drivers as “independent contractors” and failed to pay them overtime pay for hours worked in excess of forty per work week. The Complaint further alleged that Fleetgistics required its workers to use and maintain their own vehicles for work and took pay deductions for the rental of Company uniforms and equipment.
In 2014, the parties reached a class settlement exceeding $3 million.
